Kim Kardashian vs. Old Navy: Can You Trademark Pretty Brunettes?

You may or may not have seen an Old Navy commercial before. If you have, I am sorry and please invest in a DVR so that you no longer have to suffer through such atrocities.

But anyway, if you have you might have seen one of their more recent ones featuring a Kim Kardashian lookalike who keeps saying stuff is "SUPER C-U-T-E." Well, Ms. Kim K herself has (or, let's be honest, this has Kris Jenner written all over it) and she is pissed. In fact, she's super pissed!

Kardashian is now suing Old Navy for a ridiculous $20 million, stating that they are using her likeness to sell poorly made discount Gap apparel. Old Navy buyers, she says, are being tricked into thinking Kim represents the brand.

The question is - can you win a lawsuit against a company for using someone that is not you, when they never said it was you, just because it might look like you? Even if you're super c-u-t-e? I doubt it.  But it's kind of funny, especially when you realize that said lookalike model is actual Melissa Molinaro, Kim's ex-BF Reggie Bush's new girl. Apparently, Old Navy isn't the only one trying to pass someone off as Kim.
